1. Name

The Motla Conradie Family Law Centre (hereinafter referred to as the Centre) will form part of Motla Conradie Inc and will work in association with The James 1:27 Trust.

2. Mission Statement

The aim of the Centre is to provide legal services as a Family Law Centre in the pursuit of social justice.

3. Mandate

In order to give glory to God, the Centre is dedicated to helping those in need. In John 15:12 God commands us to love others in the same way that he loves us.

The mandate of the Centre thus comes from Psalm 82: 4 which reads “Rescue the weak and the needy; deliver them from the hand of the wicked” and also Galations 6:2 “Bear one another's burdens, and so fulfil the law of Christ”.

4. Objectives

The Objectives of the Centre will be to:

Advise and assist, in the most cost effective manner, certain sections of the general public on legal issues relating to Family Law and more particularly, divorce, care of children, maintenance and domestic violence within the discretion of the head of the Centre;
Assist and advise the James 1:27 Trust in all legal matters referred to the Centre by the Trust, managed within an Association Agreement;
To establish a resource centre relating to specifically Family Law and issues concerning the welfare of children in the community;
To liaise and consult with Government Departments and NGO’s working in the field of Family Law and Child Law;
To advocate for the General welfare of women and children, more particularly, abused women and children, victims of domestic violence, human trafficking and persons with a vulnerable status;
To provide popular legal education, in family law and related matters, to the general public by means of printed and social media, including radio programmes, pamphlets and articles;
To comment on post Legislation and monitor the implementation of new legislation with the view to representations to relevant authorities;
To provide a negotiation and mediation service, in order to circumvent costly and lengthy litigation.

5. STAFF

The Head of the Centre is Crystal Maphalla (Attorney)

The Chief Legal Consultant to the Centre is Adv F J Bosman SC who is assisted by attorney Khumo Mokate.

The Centre intends to recruit subject matter specialists [as voluntary and ad hoc consultants at international level in order to strengthen local expertise.

6. FEES

The fee charged to clients will be in the discretion of the resident attorney in consultation with either the Head of the Centre or the Chief Consultant.

A balance will be achieved through pro bono and paying services in order to cross subsidise and ensure long term sustainability.

The Centre will also undertake to develop a menu of “social” legal products and services the cost of which will be dependent on the client’s ability to pay.
